These terms are the agreement between you and [COMPANY LEGAL NAME], [REGISTERED ADDRESS] (“we”, “us”) for using KumoBuilder. They are written to be read. By creating an account or using the service you accept them, and our Privacy Policy.
The service
KumoBuilder is a workspace for a business: an AI assistant that answers your customers on WhatsApp, Telegram, Instagram, Messenger and web chat; a shared inbox; a knowledge base; an AI website builder with hosting and custom domains; mobile app publishing; automations that notify your team; and analytics. Features change as the product does.
Your account
- You must be 18 or older and able to enter a contract for the business you represent.
- Give accurate details and keep them current. Keep your password and second factor to yourself; tell us at hello@kumobuilder.com if you think someone else has them.
- You are responsible for what happens under your account and for the people you invite to your workspace. The workspace owner controls who is in it.
Plans, payment and refunds
- A new workspace starts on the Free tier, which includes no AI usage and no websites. There is no free trial.
- Paid plans are $150, $390 and $890 a month (US dollars; taxes may apply). Each includes an allowance of AI usage (“tokens”) and a number of websites. Prices are on the pricing page.
- Each payment buys 30 days. Nothing renews automatically. When the 30 days end without another payment, the workspace returns to the Free tier: the AI stops answering and you cannot build or change websites with the AI until you pay again. Websites already published stay online. There is nothing to cancel.
- When a month’s allowance is used up, the AI stops until you top up or move to a larger plan. Top-ups are available on paid plans. Nothing is charged without you choosing it.
- Payments by bank transfer or wallet are checked by a person against a statement before the plan or top-up is applied, so there can be a delay. A payment reference submitted twice is credited once.
- Refunds: [REFUND POLICY — e.g. whether unused days or tokens are refunded, and any statutory cooling-off right]. See also the Refund Policy.
Your content, and your customers’ data
What you bring stays yours — documents, products, messages, websites, and your customers’ data. You give us a licence to host, copy, process, transmit and display it only as needed to run the service for you, including sending it to the providers named in the Privacy Policy. The licence ends when the content is deleted.
Websites and apps you generate are yours, including their code. Custom domains stay yours: you point them at us and can point them elsewhere.
Your customers’ data: you are the controller and we are your processor. You are responsible for having a legal basis for it, for telling your customers how it is used (including that an AI answers them), and for what your website collects. We process it only on your instructions to provide the service. [DATA PROCESSING AGREEMENT — link or “available on request”]
AI output
The assistant and the website builder produce drafts. They can be wrong, and confidently wrong. You are responsible for what is sent or published on your behalf, and for checking anything where a mistake matters — prices, medical, legal or financial advice. You can take over any conversation and review any site before publishing. AI output is not professional advice, and similar output may be produced for other people.
What you may not do
You may not use KumoBuilder to:
- send messages people did not ask for, or anything a messaging platform’s own rules forbid;
- impersonate anyone, or mislead people about who — or what — is answering them;
- collect or process data you have no right to, or data from children in breach of the law;
- publish anything unlawful, infringing, deceptive, hateful or harmful;
- try to reach another workspace’s data, probe or overload the service, or get around its limits;
- resell access without our written agreement.
You must also follow the terms of the platforms you connect (Meta, Telegram, Google, Apple). A platform that changes its rules or revokes a token affects your channel; reconnecting is yours to do.
Availability
We work to keep the service running and fix problems quickly, but we do not promise any particular uptime, and there is no service-level agreement. Channels depend on providers we do not control.
Ending it
You can stop at any time: simply do not pay for another month. You can delete your own account, or the whole workspace, in Settings; deletion happens seven days after you ask and cannot be undone. A workspace on a paid plan can be deleted once its paid month ends. Export your data first.
We can suspend or close a workspace for a serious or repeated breach of these terms, for non-payment of an amount actually owed, or where the law requires, and we will say why. Where it is safe to, we give notice and time to export.
Liability
The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to what you paid us in the 12 months before it. [CONFIRM LIABILITY CAP WITH COUNSEL]
Nothing in these terms limits liability that cannot legally be limited, or the rights you have as a consumer where those laws apply.
Law and disputes
These terms are governed by the law of [GOVERNING LAW COUNTRY]. Disputes go to the courts of [COURTS / VENUE], unless the law where you live gives you the right to bring them there. Tell us first at hello@kumobuilder.com; most things are settled faster that way.
Changes to these terms
We update the date at the top when these terms change. For a change that matters, we email account holders at least 30 days before it takes effect. Continuing to use KumoBuilder after that means accepting the new terms; if you do not, you can stop and delete your data.
